Contract between Royal Government of Cambodia and Delcom Cambodia Pte.Ltd on Mining Investment in Phnum Daek areas, Rovieng District, Preah Vihear Province

This contract was made between the Royal Government of Cambodian representative, the Ministry of Industry, Mines and Energy, and Delcom Cambodia Pte., Ltd. on 24 March 1994. Its objective is for mining exploration, development and exploitation in the licensed area. The licensed size covered over the total area of 216 square kilometers with its coordinates being detailed in the Annex 1 and the map in Annex 2 and 3.

Party's obligation in the implementation of the project

1- Financial obligation: - payment for tax on annual profit - land concession fees - payment for fees on registration, license extension, forest rights, transfer rights, and other general services. 2- obligation for protecting the environment.

Environmental protection obligation

After its mining exploration operation finished, the contractor shall be responsible for restoring the environment, including soil erosion protection, in its licensed operation areas.

Socio-cultural protection

The contractor and its employees shall respect traditions of local residents who live in its licensed areas and shall not interfere in their daily lives.

Fiscal duties summary

The contractor shall pay tax on annual profit based on: A. 26% of the net profit if the contractor earns up to 500,000 USD, B. 30% of the net profit if the contractor earns from 500,001 to 1,000,000 USD, C. 35% of the net profit if the contractor earns from 1,000,001 to 2,000,000 USD, D. 40% of the net profit if the contractor earns from 2,000,001 to 5,000,000 USD, E. 45% of the net profit if the contractor earns more than 5,000,000 USD.
